Improve the Clarity by Adopting a New Agreement The current agreement is a combination of several previous agreements/amendments that refer back to these previous agreements which has created a cumbersome process of reviewing previous agreements and amendments to determine current practice. To address this situation, members are recommending adoption of a new stand-alone comprehensive agreement that covers all operations of the ACCWP. This new agreement would supersede all prior agreements and New Miscellaneous Provisions In addition to the more major revisions detailed above the new MOA includes a number of minor revisions including incorporating the most recent Basin Plan and NPDES permits, eliminating reference to outdated funding commitments, clarifying program invoicing and termination procedures, establishing a new 15-year term clarifying and modifying procedures for a party to terminate its participation, updating duties of the parties, and clarifying that the Management Committee's approval of reports submitted to the Regional Water Board are approved by all parties.
