24. That there shall be no buildings on the subject <br /> property over three stories or 40 feet in height <br /> at the parapet. <br /> <br />25. That a maintenance district or some other privately <br /> funded comprehensive procedure shall be used for' <br /> the maintenance of all interior street surfaces, all <br /> public lighting and landscaping within the development <br /> and all required landscape/berm areas. The Valley <br /> Avenue and Bernal Avenue medians xn front of the <br /> subject property shall be maintained in the same <br /> manner. <br /> <br />26. That site specific, soil studies shall be done <br /> for all buildings constructed on the subject property. <br /> <br />27. That all buildings on the subject property shall <br /> employ solar energy to the maximum extent reasonable, <br /> as determined by the Design Review Board. <br /> <br />28. That the developer shall retain an archaeologist <br /> during excavation on the subject property; said <br /> archaeologist to be called to examine any arti- <br /> facts unearthed during excavation. <br /> <br />29. That.all public street rights-of-way shown on the <br /> final map shall be offered for dedication to public <br /> use, or in the alternative these rights-of-way may be <br /> purchased at their fair market value through a <br /> special assessment district for subdivision improve- <br /> ments, if approved by the City Council pursuant to <br /> Section 66462(a)(2) of the Government Code. <br /> <br />30. That where enumerated conditions of this PUD report <br /> conflict with statements on the PUD development plan, <br /> the former shall control. <br /> <br />31. That a comprehensive overall signing program for the <br /> entire development shall be submitted to and approved <br /> by the staff prior to issuance of a building permit. <br /> <br />32. That the developer acknowledges that the City of <br /> Pleasanton does not guarantee the availability of <br /> sufficient sewer capacity to serve this development <br /> by approval of this project and that the developer <br /> agrees and acknowledges that building permits may <br /> be withheld if sewer capacity is found by' the City <br /> not to be available. <br /> <br /> -4- <br /> <br /> <br />
