AMENDMENT TO THE <br /> CONTRACT BETWEEN <br /> ZONE 7 OF ALAMEDA COUNTY FLOOD CONTROL AND <br /> WATER CONSERVATION DISTRICT AND CITY OF PLEASANTON <br /> THIS AMENDMENT to the Contract between Zone 7 of Alameda <br /> County Flood Control and Water Conservation District, hereinafter <br /> referred to as "Zone 7, " and the City of Pleasanton, hereinafter <br /> referred to as "Pleasanton, " is made and entered into this <br /> day of 1991, <br /> WITNESSETH, that: <br /> WHEREAS, Zone 7 and Pleasanton have entered into a treated <br /> water supply contract dated March 12 , 1968 ; and <br /> WHEREAS, Paragraph B3 of said contract provides that "the <br /> Independent Quota for the following year shall be reduced by the <br /> amount by which such production in the preceding year exceeded <br /> the Independent Quota" ; and <br /> WHEREAS, Paragraph B4 of said contract provides for payment <br /> of a Recharge Fee by Pleasanton to Zone 7 for independent water <br /> production in excess of Independent Quota; and <br /> WHEREAS, in the 1991 calendar year Zone 7 has been notified <br /> by the State of California that its Project water deliveries will <br /> be reduced by eighty percent; and <br /> WHEREAS, Zone 7 wishes to produce, by all means available, <br /> as much water as possible; and <br /> WHEREAS, Pleasanton has pumping capacity available over that <br /> necessary to pump its Independent Quota under said contract; <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED as follows: <br /> 1 <br />
