DISCUSSION <br /> The primary issues raised at the February 8, 2012, Joint City Council/Planning <br /> Commission Workshop included the depth of live/work spaces, noise and air quality <br /> conditions on Site 1, the status of trail connections, the plan for completion of Owens Drive <br /> narrowing, the potential for a larger park on the Shaklee property, the appropriateness of <br /> the projects designs, and consistency with the Climate Action Plan. Additional analysis <br /> and discussion of the proposal is included in the attached March 14, 2012, Planning <br /> Commission staff report (Attachment 10). The discussion includes: project history, <br /> General Plan conformity, zoning and uses, Hacienda TOD Standards and Design <br /> Guidelines exceptions, surrounding cities live/work depth information, affordable housing, <br /> traffic and circulation, parking, noise, grading and drainage, landscaping, Green Building, <br /> on-site common and private open space, signage, school impact, and Development <br /> Agreement Modifications. <br /> Live/work Space Depth <br /> In response to concerns raised by the Council at the Joint Workshop, the applicant revised <br /> the project to extend all of the live/work spaces to a 40-foot depth. This was achieved by <br /> extending the buildings forward rather than extending the live/work backward into the <br /> internal parking area. This modification would require an additional exception from the <br /> design guidelines as the building would now extend into the required 20-foot setback along <br /> Owens Drive in front of Building H1. Staff believes that this solution is satisfactory with <br /> one minor change. Staff has included a condition of approval in our recommendation <br /> requiring that the depth of live/work in Building H1 along Owens Drive only be extended to <br /> accommodate a 38-foot depth so that a 16-foot minimum setback from the curb can be <br /> maintained. This minimum depth of setback was recommended to staff by consulting <br /> Urban Designers, Van Meter Williams and Pollack. <br /> Noise and Environmental Concerns for proposed Owens Drive Plaza <br /> Concerns were raised regarding noise levels and levels of toxic air contaminants in the <br /> proposed plaza on Site 1 on the corner of Owens Drive and Willow Road. <br /> Noise <br /> Noise levels at the proposed plaza are approximately 70 dBa. While we do not have a <br /> standard for urban plazas, this is in the middle of the Conditionally Acceptable range for <br /> "parks." Mitigating factors for noise levels in the plaza include the provision of <br /> landscaping, a low wall feature, and a water feature. Noise levels at the plaza will also be <br /> significantly reduced when the BART property is developed and the noise from the <br /> freeway is blocked by the new buildings. <br /> Air Quality <br /> The total maximum lifetime cancer risk for project residents due to air toxics from <br /> roadways (including Interstate 580) for receptors in that area is approximately 48 in a <br /> million (total cancer risk from cumulative sources, i.e., including both mobile and <br /> stationary sources, is 62 in a million). This does not account for any mitigation (such as air <br /> filtration) and assumes 24 hours/day, 350 days/year, and 70 years exposure time. This <br /> Page 9 of 14 <br />
