MOTION: It was m/s by Cook-Kallio/Sullivan to waive full reading and adopt Resolution No. 12-496 <br /> approving the appeal of Brian and Christine Bourg, thereby overturning the Planning Commission's <br /> approval of the application of Dave and Francine Cunningham for Design Review approval to replace <br /> the approximately 482 sq. ft., single-story house (located at 205 Neal Street with an approximately <br /> 1,710 sq. ft., two-story residence and for variances to: (1) reduce the front yard setback from the <br /> required 23 feet to 20 feet; (2) allow one required off-street parking space to be located in the front yard <br /> setback; and (3) allow tandem parking, as filed under case nos. p11-0709 and p11-0717. Motion <br /> passed by the following vote: <br /> Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan <br /> Noes: Councilmember Thorne, Mayor Hosterman <br /> Absent: None <br /> Mayor Hosterman questioned staff as to what the applicants can do in moving forward. Mr. Dolan said <br /> the applicants must wait one year before they could apply with the same project. There is no limitation <br /> for them to re-apply with something considered substantially different. <br /> 9. Public Hearing: P11-0997, City of Pleasanton —Adopt a Climate Action Plan (CAP) and adopt a <br /> General Plan Amendment to incorporate the CAP by reference in the General Plan Air Quality <br /> and Climate Change Element <br /> Mayor Hosterman opened the public. <br /> MOTION: It was m/s by Hosterman/McGovern to continue the public hearing to February 13, 2012. <br /> Motion carried by the following vote: <br /> Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Noes: None <br /> Absent: None <br /> 10. Approve a Memorandum of Understanding between the City of Pleasanton and the Pleasanton <br /> Police Officers Association for the term June 1, 2011 through May 31, 2014 <br /> Mayor Hosterman reported that the Council heard the item from John Bartel, President and Chief <br /> Actuary of Bartel &Associates, and asked staff for a brief report. <br /> City Manager Fialho introduced the item and said after months of completed labor negotiations process <br /> with the PPOA for a new Tentative Agreement would run through May 31, 2014. The financial impact <br /> associated with this is a $2.4 million savings through FY 2013-14. The Tentative Agreement specifically <br /> establishes the following key points: The agreement term runs through May 31, 2014 and it allows a <br /> significant amount of flexibility to make adjustments should the economic environment drastically <br /> change; there are no CPI adjustments proposed, but the more significant ones they focused on which <br /> has been a constant theme has been employees assume the full 9% Employer Paid Member <br /> Contribution (EPMC) starting with 3% beginning immediately and growing to 6% starting in July 2012 <br /> and growing to 9% by 2013 applying universally to current and new employees; implementation of a <br /> new pension plan for new employees; tier two retirement benefits are payable at 3% at age 55 instead <br /> of 4% at 50 formula. This is reflected in Exhibit A and both contributions from employees and the <br /> transition from 3% at 50 to 55 results in substantial savings through FY 2021-22; new retiree medical <br /> program benefits for new hires include single party coverage only and end when the employee <br /> becomes Medicare eligible; they also worked on a number of other things related to scheduled time off, <br /> clarification of shift and scheduling matters and frequency of performance evaluations; and Exhibit B <br /> reflects the number of agencies which are still at 3% at 50 and the less than 5 which have migrated to <br /> the second tier, Pleasanton being one of them. <br /> City Council Minutes Page 21 of 25 February 7, 2012 <br />
