b. Growth Management Approval. Following its determination that a proposed <br /> Jl project is a qualifying affordable housing project and that there are units available in the <br /> affordable housing suballocation to allocate to it, the city council,at its discretion, may <br /> grant an allocation to the project for such year or years as it deems necessary to allow <br /> construction of the project consistent with city growth management policies. The city <br /> may exercise its discretion in determining both the size of a qualifying project as well as <br /> its phasing. The council approval shall be in the form of an affordable housing <br /> agreement. <br /> B.Major Project. A major project developer must receive a specific allocation for the number of <br /> units and years in which its project's units will be built. This allocation must be made from the <br /> suballocation for major projects. <br /> I. Availability of Building Permits to Major Projects. <br /> a. Initial Suballocation and Adjustments. The major project suballocation shall be <br /> as initially established in Section 17.36.070(B)(2)of this chapter and may be modified <br /> from time to time by the city council as described in Section 17.36.070 of this chapter. <br /> b. Unused First-Come, First-Served Suballocation: On December I st of each <br /> calendar year, a major project developer which has received growth management <br /> approval is eligible to secure building permits from the first-come, first-served <br /> suballocation, including its 15 units set-aside, if the suballocation for that calendar year <br /> has remaining units available. <br /> 2. Approval Process. <br /> a. Prior Discretionary Project Approval Necessary. <br /> (1) A major project developer may request a growth management allocation <br /> at the time of, or after, any of the following: PUD plan approval, design review <br /> approval,or a tentative map approval. The planning division shall provide the <br /> necessary application forms, and a project developer must file the application with <br /> the planning division. The application shall be accompanied by a fee established by <br /> the resolution establishing fees and the charges for various municipal services. The <br /> request shall indicate the desired phasing of the project. <br /> (2) No application for a major project allocation will be accepted for <br /> processing by the planning division if capacity within the major project <br /> suballocation is not available for a reasonable project phase within at least the <br /> second calendar year after the year the application is tendered. <br /> b. Growth Management Approval. <br /> (I) The major project suballocation established in Section 17.36.070(B)(2) <br /> of this chapter shall not be exceeded. The city council may grant a specific growth <br /> management allocation to a project for one or more years so long as the total units <br /> allocated to major projects in any given year does not exceed the suballocation for <br /> that year. <br /> (2) In reviewing a major project developer's request for allocation,the city <br /> council shall use its discretion in establishing a phasing schedule, giving <br /> consideration to the number of major projects which are pending or are likely to <br /> seek approval in the near term, the principle of"first-come, first-served,"the <br />
