1.5 After completion of the Bridge Improvements, City shall obtain an encroachment permit from Zone 7 prior to making any major additions or modifications or reconstruction of the Bridge Improvements upon the property of Zone 7 as well as any associated Channel maintenance activities. City shall provide plans for review and approval prior to making any major additions or modifications or reconstruction of said Bridge. Zone 7 shall, upon review and approval of plans, issue said permit within three (3) working days, if possible, at no cost to City. 1.6 City agrees that upon the completion of any of its work within Zone 7's property, to restore Zone 7's property to the condition in which it was prior to the commencement of said work or as acceptable to Zone 7. City shall, at City's sole cost, promptly repair any damage to Zone 7's real and personal property, arising out of or in connection with City's construction, operation, maintenance, replacement, repair or removal of the Bridge Improvements as well as any associated Channel maintenance activities. In the event after written notice is provided by Zone 7, the City fails, is unable or refuses to maintain or repair its Bridge Improvements or Channel within the Easement Area, or to otherwise take action(s) necessary to protect Zone 7's real and personal property from damage, Zone 7 shall have the option to perform any necessary work to protect its property from damage or to maintain, repair, alter or replace Zone 7's property damaged due to City's lack of or failure to maintain or repair its Bridge or to take action to protect Zone 7's property . City shall be responsible for any costs incurred by Zone 7 in connection therewith and shall promptly reimburse Zone 7 upon receipt of written invoice. 2. Maintenance Responsibilities: 2.1 Bridge: The City, at its cost, shall be solely responsible for the maintenance and repair of the Bridge Improvements including those which are a result of any damages from storm flows, slides and other causes. 2.2 Channel Area: City, at its cost, shall be responsible for periodic inspection of the Channel and the prompt removal of litter, fallen trees, vegetation and debris that may obstruct the flow of water or lead to scouring or erosion of the Channel within the Easement Area, excepting the desilting of the channel. 2.3 Channel Slopes. City shall further be responsible for maintaining or repairing the channel slopes and any roadways damaged from Channel scouring or erosion within the Easement Area. Such maintenance and repairs shall include the responsibility to obtain any regulatory approvals and comply with all applicable permits issued including: US Army Corps of Engineers, State Water Resources Control Board and California Department of Fish and Game. 3.
