THE CITY OF 7 1 -,- "' CITY COUNCIL AGENDA REPORT pL£ASANTONo February 21, 2012 Community Development Engineering Division TITLE: ADOPT A RESOLUTION INITIATING FORMATION OF UNDERGROUND UTILITY DISTRICT NO. 12-01 AND SETTING A PUBLIC MEETING SUMMARY Work on the Stanley Boulevard Underground Utility District started in 2008 when Council directed that the project be designed. At the time it was envisioned that once the design was complete and the construction cost was refined, the project would be funded through the City's Capital Improvement Program (CIP). Under this funding plan, on May 4, 2010, Council held a public hearing and passed Resolution 09-01 which created the Stanley Boulevard Underground Utility District (UUD) under the PG&E Rule 20B program. However, at this time there is no funding available within the CIP to construct the project. Staff is now recommending the PG&E Rule 20A program as a potential funding source for the project This program requires that the City again conduct a public hearing to ascertain whether the public necessity, health, safety or welfare requires the removal of the poles, overhead wires and associated overhead structures, as well as the undergrounding of wires and facilities for supplying electric communication, or similar/associated services. The Rule 20A funding program also requires adoption of a resolution to form the Rule 20A UUD. It should be noted that under the Rule 20A program the actual construction of the project will not occur until 2016 due to the length of the queue of projects and the revenue collection rate. Staff is recommending moving forward with the formation of the district to get into the queue, but will continue to review available funding with the goal of expediting the project. RECOMMENDATION 1. Adopt a resolution setting April 3, 2012, at the hour of 7:00 p.m. in the Council Chambers, as the time and place of a public hearing on the formation of Underground Utility District No. 12-01, Stanley Boulevard from Santa Rita Road to First Street. 2. Direct the City Clerk to mail notices of the public hearing to all affected property owners and utility companies. FINANCIAL STATEMENT The underground utility district improvements, once accepted by the public utility companies, will be operated and maintained by the respective utility companies and will have no financial impact on City maintenance and operation costs.
