<br />Ms. Selig commented on the reference to their structure and stated that it was entirely <br />different: a six- foot by eight-foot tree fort which the children built and which is now a <br />dog house. She noted that there were three criteria placed on the structure: (1) the top <br />of the roof must be underneath the fence line so it is not intrusive on the neighbors; (2) it <br />would not kill the tree; and (3) recycled lumber was used and was wrapped in bamboo <br />shade to blend in with the neighborhood. She added that she did not find it a valid <br />reason to say that everybody in the neighborhood has one of this and, therefore, it is all <br />right for the next person to have one as well. <br /> <br />THE PUBLIC HEARING WAS CLOSED. <br /> <br />Commissioner Olson inquired if staff has any examples of neutral color to provide to the <br />applicant that could be put in as a condition. <br /> <br />Ms. Stern replied that she did not have any at hand but staff can provide some to show <br />to the applicant. <br /> <br />Commenting on the structure being angled and having more than one-and-a-half walls <br />visible to the neighbors that would be painted a neutral color, Commissioner Pentin <br />proposed that the entire structure be painted one neutral color that fits the garden or <br />backyard theme. <br /> <br />Commissioner Blank stated that, while not being insensitive to the fact that while the <br />previous structure may have had some openings, it still had a solid roof. He added that <br />he was struck by the fact that the applicant is willing to consider lowering the structure <br />as recommended by staff as well as painting the back of it in a neutral color. He <br />suggested the Commission consider adding both conditions because it puts into place <br />the same thing that was there before. <br /> <br />Commissioner Blank moved to deny appeal, thereby upholding the Zoning <br />approval of Case P11-0715, subject to the Conditions of Approval <br />listed in Exhibit A of the staff report, with the modifications that the side(s) of the <br />the review and approval of the Director of Community Development; and that the <br />height of the structure be reduced as recommended by staff. <br />Commissioner Pentin seconded the motion. <br /> <br />requested clarification from Commissioner Blank that the <br />recommendation on the neutral color on what could be visible would not preclude the <br />applicant from painting the entire structure in the same color. <br /> <br />Commissioner Blank clarified that the sides being required to be painted a neutral color <br />e structure <br />the same color if he wishes. <br /> <br />PLANNING COMMISSION MINUTES, October 17, 2011 Page 5 of 36 <br /> <br />
