The project developer shall survey the heights of the structures to verify their general <br /> conformance to the approved building height as shown on Exhibit B. Said verification <br /> shall be performed by a licensed land surveyor or civil engineer, and shall be completed <br /> and provided to the Department of Community Development before the first framing or <br /> structural inspection of each building on each lot by the Building Division. <br /> 16. Trellis-covered arbors and/or patio cover, attached to the main house or detached, up to <br /> a height of 15-feet supporting photovoltaic panels shall be exempt from the City's <br /> Administrative Design Review procedures. Design review at the Planning Division staff <br /> level and building/electrical permits will still be required. <br /> 17. Unless otherwise approved by the Director of Community Development, the precast <br /> soundwall shall match the design shown on the PUD development plan. The soundwall <br /> color shall be submitted for review and approval by the Director of Community <br /> Development with the subdivision improvement plans. <br /> 18. The site development standards for accessory structures shall be modified: <br /> a. To indicate that setbacks for covered patios, trellises, sheds, etc. shall be <br /> measured from the farthest architectural projection. <br /> b. To indicate that decks and patios shall not interfere with the rear or side yard <br /> drainage installed by the developer. <br /> Said modifications shall be incorporated into a final site development standard document <br /> which shall be subject to the review and approval by the Director of Community <br /> Development prior to issuance of a building permit. <br /> 19. The project developer shall provide all initial home buyers with copies of the project <br /> conditions of approval and the site development standards. <br /> 20. The recorded deed of sale for all lots covered by this PUD Development Plan approval <br /> shall include separately recorded disclosure statements or restrictive covenants <br /> indicating the following: <br /> a. A clause stating the existence of the Zone 7 lake located on the east side of Martin <br /> Avenue is a reclaimed Kaiser quarry pit. <br /> b. A clause indicating the close proximity of the Livermore Municipal Airport; the <br /> possible impacts to homes due to aircraft overflights; a warning that the noise <br /> generated from the Livermore Airport is a mix of business jet and small aircraft <br /> operations; that the Livermore Airport operates 24 hours per day, 365 days per <br /> year; and that the Livermore Airport has proposed an expansion of the airport. <br /> Wording for these disclosures and covenants shall be written in simple/plain language, <br /> shall be submitted to the City Attorney for review and approval before City Council <br /> approval of the first final subdivision map for this development, and shall be recorded <br /> over the project site by separate instrument. <br /> Page 8 <br />
