contribution toward City services generally, including <br /> fire services. The agreement shall be entered into <br /> prior to issuance of a building permit. <br /> <br /> 7. Approval of case PUD-82-1 is subject to conditions 4 <br /> through 31, 33 through 50 and 57 of Exhibit A, Conditions <br /> Attached to PUD-80-14, attached hereto and made part of <br /> this case by reference. <br /> <br /> 8. That the applicant be aware that there exists an overall <br /> fire hydrant location and on-site mains plan approved by <br /> the City Engineer and Fire ~arshal. The subject project <br /> will be required to adhere to this plan. <br /> <br /> 9. That at the time deemed necessary by the City Engineer <br /> the applicant shall construct a driveway through the <br /> easternmost tip of the subject property between the <br /> Carnation Restaurant site and the l~eyer property and <br /> aligned with the western driveway on the Carnation <br /> property. The purpose of this new driveway shall be <br /> to allow vehicular access between the Meyer and Carnation <br /> properties. <br /> <br />10. That no structure in Phase II shall exceed three stories <br /> in height unless approved by the City Council. <br /> <br />11. That since the development plan does not show the specific <br /> design of buildings, lot configuration, or other site <br /> development features to be constructed in Phase II, develop- <br /> ment of individual sites shall require review by the Planning <br /> Commission and City Council. <br /> <br />12. The applicant shall initiate and complete as soon as <br /> possible a review of the feasibility of a redesign of <br /> the Johnson-Hopyard intersection which would extend Johnson <br /> Drive into the subject property between the Denny's and <br /> Hungry Hunter restaurants. If,in the opinion of the City, <br /> it proves feasible to accomplish this redesign, the <br /> applicant shall endeavor to complete the redesign of the <br /> intersection and approaching street, with the assistance <br /> of the City and other property owners as necessary, in <br /> lieu of completing the Johnson Drive improvements required <br /> by Conditions 5-7 of PUD-80-14. The applicant acknowledges <br /> that if redesign is determined to be necessary, the circu- <br /> lation system, and other aspects of this PUD approval, shall <br /> require modification following hearings before the Planning <br /> Commission and the City Council. <br /> <br /> /// <br /> <br /> 2 Exhibit "A" <br /> <br /> <br />
