LIVERMORE CITY OF EMERGENCY POTABLE WATER

All labor, power, fuel and other costs incidental to the transfer incurred by agency shall be borne by that agency. The supplying agency shall invoice the requesting agency for water consumed and the requesting agency shall pay the amount due within thirty (30) days of the receipt of such invoice. 6. INTEGRATION. This Agreement represents the entire understanding of the City of Pleasanton and the City of Livermore as to those matters covered herein. No prior oral or written understanding shall be of any force or effect with respect to matters covered herein. This Agreement may not be amended or altered except in writing, signed by both agencies. 7. GOVERNING LAW. This Agreement shall be administered and interpreted in accordance with the laws of the State of California. 8. TERMINATION. Either agency may terminate this Agreement for convenience upon three hundred and sixty-five (365) days prior written notice to the other agency. Termination of this Agreement will not relieve either agency of the obligation of settling any payment amount due under this agreement for water transferred. Following termination either agency may remove its connection. Notice of termination shall be delivered by certified mail, return receipt requested.
