,f~T~t~ on the day fixed for th~ hearing, at the time and place fixed as above stated, the Codicil heard evidence offered by all interestsd persons; NOW TY~Z~EFORE, THE CI~~ CO~CIL 01~' THE CITY OF PLKqS~;NTON DOES kESOL~ ~ FOLLOWS: 1) This Council finds from all the evidence submitted, thatl the portion of Third Street here~it~r described is not necessary for present or prospective 'public street purposes, and there- fore this Council does hereby order that the following described portion of Third Street be and is hereby abandoned and vacated, to wit: Ail that lot of land situated in the ~' ~ of ~zty Pleasanton, County of Alamed, State of California, described as follows: 3'A~RCEL A, the easterly 14~ of the existing 80' right-of-way of Thmrl Street, in the City of Pleasaaton, from the south line of Nea! Street to the north line of Angela Street. PARC~ B, the easterly 14~ of the existing 80' right-of-way of Third Street, in the City of Pleasanton, from the south line of Angela to the north line of Abbie Street. EXCEPTING~ I~SE~VI~ T~REFROM, ptu~suant to the provision: of Section 8330 of the Streets and Highways Code, the easement and right at any t~e or from time to time to construct, maintain operate, replace, remove, renew and enlarge lines of pipe, con- duits, cables, wires and other convenient e~ipment and fixtures for the operation of communication lines, electrical transmission and distribution lines, nat~n~al gas lines and water lines, and for incidental purposes including access to protect property from all hazards in, upon and over all that portion of Third Street hereinbefore abandoned.
