EXHIBIT A-1 <br /> Conditions of Approval <br /> PUD-93-02-10M <br /> 2001 Ruby Hill Boulevard <br /> PROJECT SPECIFIC CONDITIONS <br /> Planning <br /> 1. All conditions of Case PUD-93-02 shall remain in full force and effect unless <br /> otherwise modified herein, except that PUD-93-02 is modified to allow the <br /> operation of the restaurant with alcohol service after 10 p.m. as covered by <br /> this approval as a conditionally permitted use. <br /> 2. This PUD development plan modification approval will lapse and shall be void <br /> on August 16, 2013, unless a building permit is issued and construction has <br /> commenced and is diligently pursued toward completion or an extension has <br /> been approved by the City. <br /> 3. The project developer shall pay any and all fees to which the property may be <br /> subject prior to issuance of building permits. Except for the sewage <br /> connection fees, the type and amount of the fees shall be those in effect at <br /> the time the building permit is issued. The sewage connection fees shall be <br /> paid to the City of Livermore. Evidence of the payment of these fees shall be <br /> provided to the Director of Building and Safety before issuance of the building <br /> permit. Because of the prior development agreement covering the property, <br /> the project developer is exempt from paying the current Citywide and area <br /> wide traffic mitigation fees. The project developer shall post address numerals <br /> on the building so as to be plainly visible from all adjoining streets or <br /> driveways during both daylight and night time hours. <br /> 4. Prior to issuance of a building permit, the project developer shall pay the <br /> applicable Zone 7 and City connection fees and water meter cost for any <br /> water meters, including irrigation meters. <br /> 5. The project developer shall effectively screen from view all ducts, meters, air <br /> conditioning equipment, and any other mechanical equipment, whether on the <br /> structure, on the ground, or on the roof, with materials architecturally <br /> compatible with the main structure. The plans shall reflect the location of any <br /> above ground utilities to provide adequate review of screening. Roof <br /> mounted equipment, the equipment shall be designed, installed, and <br /> maintained so that the equipment does not project above a horizontal plane <br /> established by the buildings' perimeter roofs.
