1) A receipt shall be provided to the PPD for any released or removed personal <br /> property, and a copy of the receipt shall be placed in the stored vehicle. <br /> 2) An Operator wishing to be excused from this requirement shall submit the request <br /> in writing outlining safeguards and procedures it has in place and consistently use. <br /> After review of these safeguards and procedures, a determination shall be made by <br /> the Special Operations Commander whether to excuse the Operator from this <br /> requirement. <br /> 3) This requirement may not be waived when a vehicle has been impounded for <br /> evidence or investigation. <br /> 4) An Operator shall release personal property from an impounded/stored vehicle at <br /> the request of the vehicle's registered owner or agent. No lien shall attach to any <br /> personal property in or on the vehicle pursuant to CVC§22851(b). <br /> 5) Personal property is considered to be any item which is not affixed to the vehicle. <br /> 6) Personal property from a stored vehicle shall be released to the current registered <br /> owner or authorized agent upon demand and without charge during normal <br /> business hours. <br /> 7) A gate fee may be charged for returning property after normal business hours, <br /> weekends, and state holidays. The maximum hourly charge for non-business hour <br /> releases shall be one-half the hourly tow rate charged for initially towing the <br /> vehicle, or less, pursuant to CVC§22851(b). <br /> C. An Operator must have a business office and a storage facility located either within the <br /> city limits of Pleasanton or within one-half mile of the city limits of the City of <br /> Pleasanton. <br /> D. Unless otherwise waived by a written addendum by the PPD, the primary storage facility <br /> for towed and stored vehicles shall be at the same location as the business address. If <br /> not at the same location,there shall be no charge for any additional distance traveled to <br /> and from a secondary location. The vehicle and/or personal property shall be released <br /> at the primary storage facility or, if acceptable to the vehicle's registered owner or <br /> agent, at a secondary storage facility. <br /> 1) Prior to the utilization of new storage facilities that were not listed on the <br /> application for the rotation tow listing,the Operator shall furnish the address in <br /> writing and seek the Special Operations Commander's written authorization. <br /> 2) A secondary storage yard shall be utilized only if the primary storage yard is full. <br /> 2011-2013 TSA Page 12 of 30 <br />
