Attachment 1 RESOLUTION NO. 11- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING THE TOW SERVICE AGREEMENT FOR THE CITY OF PLEASANTON WHEREAS, the Police Department administers a tow service agreement through which approved tow companies are included on a rotational tow list; and WHEREAS, the tow service agreement was last substantially revised in 1997; and WHEREAS, the tow service agreement was modeled after the State of California, Department of Highway Patrol (CHP) Tow Service Agreement; and WHEREAS, the CHP Tow Service Agreement has been substantially revised since 1997, and most recently this year; and WHEREAS, many local agencies, including the Alameda County Sheriff's Office, have modeled their tow service agreements after the CHP's agreement; and WHEREAS, using the same or substantially similar agreement as the CHP, the Alameda County Sheriff's Office, and other local agencies would provide consistency to tow companies and law enforcement administration; and WHEREAS, the Police Department has reviewed the CHP Tow Service Agreement and Alameda County Sheriffs Tow Service Agreement and recommends that Pleasanton's tow service agreement be revised to reflect these agreements with some slight revisions to account for particular considerations in the City of Pleasanton; and WHEREAS, the City Council of the City of Pleasanton has considered the proposed Tow Service Agreement. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: Section 1: Approves the revised Tow Service Agreement, attached hereto as Attachment A, and authorizes its use by the Police Department. Section 2: This resolution shall become effective immediately upon its passage. Section 4: City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions.
