46. That the improvement Dlans for this development <br /> specifically include a redesigned driveway from Lot A <br /> to Foothill Road. The design shall be submitted to the <br /> City Engineer for review and approval. The develoDer <br /> shall cause this driveway to be reconstructed, at his <br /> cost, prior to or concurrent with the widening of Foothill <br /> Road. This condition can be met by the Developer paying <br /> the City an in-lieu fee as determined by the City Engineer. <br /> <br />47. That the developer shall make interim improvements to <br /> Foothill Road at the new driveway location as directed <br /> by the City Engineer. <br /> <br />48. The in-lieu fee established by Conditions Noso 22 and <br /> 46 relating to Parcel A shall be reimbursed to parties <br /> paying such fee by the City if the City obtains the <br /> consideration described in those conditions in conjunction <br /> with the further subdivision of Parcel A provided, however, <br /> that the City's obligation to reimburse shall terminate <br /> upon the widening of Foothill Road or passage of ten years, <br /> whichever shall occur first. <br /> <br /> <br />
