rights-of-way therein contained belonging to the public, and also <br /> all property owned by the City of Pleasanton, the County of Alameda, <br /> the State of California, and the United States of America, contained <br /> therein, now in use in the performance of a public function. <br /> <br /> NOTICE IS HEREBY GIVEN that serial bonds to represent un- <br /> <br />' paid assessments, ard bearing interest at the rate of five per cent <br /> (5%) for the first to the twelfth maturity, and at the rate of five <br /> and one-quarter per cent (5-1/4%) for the thirteenth to the twentieth <br /> maturity, shall be issued herein in the manner provided by D£vision <br /> 10 of the Streets and Highways Code, the Improvement Bond Act of <br /> 1915, the last installment of which shall mature nineteen (19) years <br /> from the 2nd day of July next succeeding ten (10) months from their <br /> date. <br /> <br /> Proceedings for all work shall be taken pursuant to the <br /> Municipal Improvement Act of 1913, except that the bonds hereinabove <br /> described shall be J~ sued under the provisions of the Improvement <br /> Bond Act of 1915, as heretofore described. <br /> <br /> BE IT FURTHER RESOLVED that this City Council hereby finds <br /> that the Special Assessment Investigation, Limitation and Majority <br /> Protest Act of 1931 does not apply to these proceedings. <br /> <br /> BE IT FURTHER RESOLVED that, in accordance with the provi- <br /> sions of Sections 10203 and 10204 of the Streets and Highways Code of <br /> the State of California, being a part of the Municipal Improvement <br /> Act of 1913, the matter of the construction of improvements herein <br /> referred to ~ hereby referred to M~KAY & SOMPS, Engineer of Work, and <br /> the persons employed by this City Council for the purpose of having <br /> charge and control of the public improvements described in zhis Reso- <br /> lution. Said M~KAY & SOMPS are hereby directed to rm~ke and file <br /> with the City Clerk of the City~ Pleasanton a report in writing <br /> containing the following: <br /> <br /> a. Plans and specifications of the proposed improvement <br /> if the improvement is not already installed; <br /> <br /> b. A general description of works or appliances already <br /> installed and any other property necessary or conven- <br /> ient for the operation of the imprcvmment, if the <br /> works, appliances or property are ko b.~ acquired as <br /> par~ of the improvement; <br /> <br /> c. An estimate of the cost of the improvement and of the <br /> cost of lands, rights-of-way, easements and incidental <br /> expenses in connection with the improvement; <br /> <br />-3- <br /> <br /> <br />
