<br />Ms. Stern replied that this is already included in the letters. <br /> <br />Commissioner Pentin noted his abstention in regard to Site 19. <br /> <br />ROLL CALL VOTE: <br /> <br />AYES: Commissioners Blank, Narum, Olson, Pearce, and Pentin <br />NOES: None <br />ABSTAIN: Pentin (Site 19 only) <br />ABSENT: None <br /> <br />Resolution No. PC-2011-19 recommending the Draft Housing Element to the City <br />Council and the Growth Management Subcommittee as a draft to be submitted to the <br />HCD was entered and adopted as motioned. <br /> <br />Chair Narum asked Commissioner <br />amendments. <br /> <br /> <br /> <br />Chair Narum requested that the record reflect that there was unanimous Commission <br />support for its recommendations. <br /> <br />7. MATTERS INITIATED BY COMMISSION MEMBERS <br /> <br />Commissioner Blank noted that at the last meeting, there was discussion about whether <br />other cities adhere to private CC&Rs for homeowner associations (HOA). He indicated <br />that he researched the issue and that he is not 100 percent convinced that the City is on <br />solid ground in terms of its absolution. He requested staff to look into this matter and <br />return with guidance if there is case law. He further requested that staff review the <br />Planning Commission meeting minutes that established the HOA check box on <br />because he believes staff might <br />find that it was established for the expressed purpose of ensuring HOA approval. <br /> <br />Ms. Harryman stated that she would look into this matter and advise the Commission of <br />her findings at a future meeting. <br /> <br />8. MATTERS FOR COMMISSION'S REVIEW/ACTION <br /> <br />a.
