AGREEMENT <br /> <br />THIS AGREE~N~r, made and entered into this 94th day of February, <br /> <br />1964, by and between the CITY 0P PLEASAN~0N, a municipal corporation of <br /> <br />the State of California, hereinafter called "City", and STb~RGIS, DEN-DUI~K, <br /> <br />DOUGI~SS & ANDERSON, Attorneys at Law, hereinafter called "Special Bond <br /> <br />Counsel"; <br /> <br />W ITNESSETH : <br /> <br />That for and in consideration of the mutual covenants and <br /> <br />agreements herein contained, the parties hereto agree as follows: <br /> <br />1. City proposes to initiate proceedings for the acquisition of <br /> <br />improvements to be made in "Assessment District No. 64-1, City of Pleasan- <br /> <br />ton, County of Alameda, State of California". <br /> <br />2. City hereby employs Special Bond Counsel and said Special <br /> <br />Bond Counsel hereby agrees to accept employment by City as said Special <br /> <br />Bond Counsel for said proceedings. Said services shall include the <br /> <br />following: <br /> <br />ae <br /> <br />Such preliminary consultations and advice as are neces- <br />sary with City officials, or City officials and <br />groups not comprised of City officials, to determine <br />the best proceedings to be taken and what district is <br />to be formed; <br /> <br />be <br /> <br />Preparation of all resolutions, notices and other <br />papers, documents and proceedings required by the pro- <br />visions of the "Special Assessment Investigation, Limi- <br />tation and Majority Protest Act of 1931" of the State of <br />California; <br /> <br />Preparation of all resolutions, notices and other papers, <br />documents and proceedings required by the provisions of <br />the "Municipal !mpr ~ement Act of 1913" in carrying through <br />the proceedings for the work contemplated; <br /> <br />Complete supervision of all stages of the proceedings <br />and attendance at such public and private meetings as <br />are reasonably necessary to carry through the project <br />to completion; <br /> <br />em <br /> <br />Special Bond Counsel is to be available for consultation <br />by City officials, groups or individuals for information <br />by telephone or otherwise, if it can be arranged; <br /> <br />Special Bond Counsel agree that ~here shall be included <br />in the amount of the fee provided to be paid opinion to <br />the purchaser or purchasers of bonds which may be issued <br />in the proceedings. <br /> <br />3. The fee herein provided for does not include out-of-pocket, <br /> <br />transportation, communication, or other out-of-pocket expenses of Special <br /> <br />Bond Counsel, nor does it include compensation for acquisition of properties <br /> <br />to be acquired either by litigation or negotiation. In the event City <br /> <br />shall desire to have Soecial Bond Counsel conduct proceedings for acqulsi~o <br /> <br />-1- <br /> <br /> <br />
