32. That the storm drainage system for this development <br /> be a public system within the street P.S.E. unless <br /> otherwise approved by the City Engineer. <br /> <br />33. That the water system for this development be a public <br /> system within the street P.S.E. unless otherwise approved <br /> by the City Engineer. <br /> <br />34. That the sanitary sewer system within this development <br /> be a public system within the street unless otherwise <br /> approved by the City Engineer. <br /> <br />35. That all buildings and/or structures must comply with <br /> all codes and ordinances in effect at the time required <br /> permits are issued by the Building Division. <br /> <br />36. That at least 40% of the units (96 units) shall be <br /> occupied solely by persons 50 years old or older. This <br /> shall be accomplished as follows: <br /> <br /> a. In conjunction with final map approval, developer <br /> shall designate 72 specific units which shall be <br /> reserved solely for occupancy by persons 50 years <br /> old or older. This occupancy condition shall run <br /> with the lots so designated and shall be enforceable <br /> by the City pursuant to this ordinance. In addition, <br /> the Covenants, Conditions and Restrictions shall <br /> establish this restriction and provide that the <br /> Homeowners Association shall enforce the restriction <br /> and that the City may enforce this restriction as <br /> a third party beneficiary to the CC&Rs. <br /> <br /> b. The remaining 10 percent of units (24 units) reserved <br /> for persons 50 years old and older may be sold at <br /> various locations throughout the project. In the <br /> case of these units, ongoing restrictions shall <br /> not be required because normal homeownership <br /> patterns indicate that at least 24 units out of <br /> the remaining 166 units will be occupied solely <br /> by persons 50 years old or older. <br /> <br /> -4- <br /> <br /> <br />
