improvements, or as to the Engineer of Work's estimate of said costs and expenses, or against the diagram, or the assessment, to pay the cost and expenses thereof; that no person appeared at the time fixed for said hearing to make, nor did any person make, any oral ob- jection or protest against any of the above, matters, or the acquisition of improvements; that no one appeared or protested or made any objec- tion to said Engineer's Report, or said improvement proceedings, at any time. 2. That the district benefited by said acquisition of improve- ments, and to be assessed to pay the cost and expenses thereof, and the exterior 6oundaries thereof, is more particularly described in the Resolution of Intention hereinabove referred to, as amended, and made a part hereof by reference thereto. That all public streets and high- ways within said district, the same being in use in the performance of a public function as such, shall be omitted from said district and from the levy and collection of the special assessments to be hereafter levied and collected to cover the costs and expenses of said acquisi- tion of improvements. 3. That the Engineer of Work has filed an Engineer's including Assessment and Diagram, which said Engineer's Report hereby approved finally by this resolution. That the Engineer c has also filed an estimate of the detailed cost of said., acquisitic~ of improvements, and the incidental expenses in connection therewith, which said estimate of cost and incidental expenses is hereby finally approved and adopted as the Engineer's total and detailed cost of said acquisition of improvements and of the costs and expenses and incidental expenses in connection therewith. The Treasurer of the City of Pteasan- ton is hereby authorized and directed to disburse funds realized from the levy of assessments and the sale of bonds in the within proceedings in accordance with the amounts set forth in said Engineer of Work's estimate of cost. 4. That the public convenience and interest require, and said City Council hereby orders the acquisition of improvements to made zz described in, and in accordance with, said Resolution of ~nz±on~ as amended, on file in the office of the City Clerk of ~?~ City -2-
