e) For private rentals and other non-City sponsored events, the City will, in most cases, strongly encourage that Little Valley Winery be utilized as the exclusive wine and beer purveyor for the event. The City and Little Valley Winery understand and agree that some renters' events. i.e. fundraisers, promotions, etc. may require the participation of additional catering services and wine/beer vendors. The City and Little Valley Winery also understand that the City reserves the right to use concessionaires and wine vendors other than Little Valley Winery for a maximum of three(3) additional City-sponsored events during the Term of this Agreement, but for any specific Event, the City will offer Little Valley Winery the first Right of Refusal to support that Event. f) A private group within the Firehouse Arts Center may not distribute any product that is being sold or that is in direct competition with those products being sold by the Little Valley Winery during any performance and/or event where Little Valley Winery is conducting its normal concession sales operations. 3) Conduct of Concessionaire Staff a) As Concessionaire Staff may appear to the general public to be employees of the City, Concessionaire Staff must conduct themselves with utmost professionalism and offer good Customer Service. b) Little Valley Winery agrees to follow the City's policy of no consumption of alcoholic beverages while onsite at the Firehouse Arts Center, "working" a City sponsored performance or event. Failure to adhere to this policy by any Little Valley Winery Staff or their volunteers may be grounds for termination of this Agreement. 9
