72. The Deer Oaks Homeowners Association will be responsible for <br /> maintenance of the emergency access road in an unobstructed and <br /> weedfree condition. <br /> <br />73. That if approved, the emergency access road, and the ravine storm <br /> water collection and discharge system may be realigned with t'he <br /> approval of City staff in order to either: <br /> <br /> a. better protect existing trees or 'vegetation; <br /> b o provide a safer or more maintenance-free design; or <br /> c. reduce necessary cuts or fills. <br /> <br />74. That grading for both streets, the 16 ft. driveway and the e,.~ergency <br /> access road shall be substantially as shown on the Grading Plan, <br /> Exhibit B~ on file with-the Planning Division~ A minimum smount <br /> of on-site grading shall take place, with lots remaining essentially <br /> in a natural condition. Plans for all on-site grading shall be <br /> submitted to the City for approval at the earliest time possible <br /> in the development process. No on-site or off-site grading shall <br /> take place without prior City approval. <br /> <br />75° That all buildings and/or structures must comply with all codes <br /> and ordinances in effect at the time required permits are iss~l~ed <br /> by the Building Division, <br /> <br />76. That flexible sewer and water pipe; acceptable to the City, shall <br /> be used in the development of the project to the maxim~um extent <br /> practicable. <br /> <br /> 77. That if any historic artifacts are discovered during constr~cti'on <br /> on the subject site, construction shall be halted and a qualified <br /> archeologist called in to evaluate the material. <br /> <br /> 78. That grading on the subject site shall be confined to between the <br /> months of April and November. <br /> <br /> 79. That trees shall be planted along the eastern edge of Deer Oaks <br /> Court and the eastern sides of the homes on lots 7, 8~ 11 and 12~ <br /> 80° That tree removal on lots 1, 17, 18 and 19 be kept to the minimum <br /> extent possible. <br /> <br /> 81. That passive solar features shall be incorporated into the design <br /> of all homes on the subject property to the maximum extent <br /> practicable. <br /> <br /> <br />
