He said all the properties that have greater than the recommended density <br /> would become legal non-conforming uses and if torn down would have to be built according to the <br /> General Plan,or the General Plan would need to he changed. If the application included 10 or more <br /> units it would need a vote of the electorate. On properties that are vacant, the initiative states the <br /> medium residential density description would become 2 — 4 units per acre. The table that is <br /> indicated in the staff report tries to indicate the impact of the initiative on individual properties. <br /> The table does not intend or does not include the changes to developed properties. The <br /> development that has occurred since the 1960's would have a new General Plan designation but the <br /> initiative would have no impact on that development. The impact would be felt in those areas that <br /> currently allows some redevelopment at a higher density. Ms. Michelotti said the Housing Element <br /> is supposed to maintain the amount of high density residential acreage currently designated on the <br /> General Plan map, discourage the redesignation of areas designated for high density and encourage <br /> densities of 15 units per acre. She understood the initiative would eliminate certain densities and <br /> vacant parcels would be in the 2 —4 units per acre range. <br /> Mr. Swift said this is true for vacant land, but not for currently existing development. The <br /> of vacant parcels and parcels that are currently designated high density would be eliminated from <br /> the General Plan Land Use Map. <br /> Ms. Michelotti understood if the density in the downtown area density were to be changed, <br /> it would have to go to the vote of the people. <br /> Mr. Swift said it would be a General Plan change. It might not need to go to the vote of the <br /> people if it were done on a parcel by parcel basis because the vote would only be required if it <br /> involved ten or more units. <br /> Ms. Michelotti understood if a property were developed over the mid-range and something <br /> happened and it had to be redeveloped,it would have to be rebuilt according to the initiative. <br /> Mayor Tarver said according to the staff report the impact of the CAPP Initiative on <br /> residential parcels downtown small. An election would be unlikely. <br /> Mr. Swift said staff feels that there would be very few new units in the downtown area. <br /> Moreover,those that would be allowed would generally fall under the 10-unit requirement. <br /> Ms. Michelotti asked if a property owner with four units wanted to develop to 12 units <br /> would that need to go to the vote of the people. <br /> Mr. Swift said it depends on how the initiative is interpreted. The increase density would <br /> not need to go to the vote of the people,but any development over 10 units would. <br /> Ms. Ayala asked if there was anyway to correct the inconsistencies through the Specific <br /> Plan process. Mr. Swift said no.
