She wanted to let the community <br /> know that there are multiple funding sources for facilities available. She said the letter suggests <br /> that the list of school projects could be changed to delete facilities that the development community <br /> is paying for. If CAPP passes developers might feel they might be able to remove projects from the <br /> list. She felt this was not fair. She had concerns over the shortfall. The agreement specifically <br /> states that no surplus may occur,but that a shortfall may occur. <br /> Mayor Tarver said potential litigation needed to be discussed in a closed session. <br /> Brian McGuire, 233 Del Valle Court, felt his property should not fall under the CAPP <br /> Initiative. He recapped the process and problems he has dealt with since his property was annexed <br /> to the City in 1991. He just wants to develop his property. If CAPP is passed his property will be <br /> disqualified agricultural. He did not believe this was fair. He said the CAPP Initiative takes away a <br /> land owner's rights. He asked for Council's support to help him develop his property. He also <br /> expressed his concern regarding the effect the Initiative will have on the Vineyard Corridor. He <br /> asked Council to make the right decision and help fast track the Vineyard Corridor. <br /> Maureen Nokes, 5415 Corte Paloma,had a concern with who would pay for the LAVWMA <br /> pipeline extension if the CAPP initiative passes and no new development elects to come to <br /> Pleasanton. <br /> Mayor Tarver said other alternatives are being researched. <br /> Ms. Acosta explained the assessment district process and said the people would have to <br /> vote whether the community wanted an assessment district or not. <br /> There was a break at 10:00 p.m. <br /> The meeting reconvened at 10:10 p.m. <br /> Mayor Tarver indicated that item 6c(4f),the proposed four-hour parking zone on Pleasanton <br /> Avenue south of the Fairgrounds and the ACE rail parking lot entrance,was being continued to the <br /> next City Council meeting,due to the late hour. <br /> Ken Chrisman, 1944 Vineyard,asked how the Initiative would affect Happy Valley? Will <br /> Happy Valley be zoned agricultural? Of the five areas listed on the Initiative,Vineyard Corridor is <br /> the only property that is currently within the City's boundaries. The other properties have the <br /> alternative to appeal to the County for consideration. Does this same opportunity apply to the <br /> Vineyard Corridor'? He did not understand why the Vineyard Corridor is being considered with the <br /> other properties. He believed San Francisco would negotiate something in the County. Is the <br /> concept of agricultural within the City just a way to control open space or is it really an opportunity <br /> for some property owners to have an economic value for their land.
