for property that falls within the General Plan's and on growth boundary. The Initiative replaces <br /> representative form of government with mob rule. She said needless money would be spent on <br /> lawsuits and elections instead of sports parks and community centers. The current planning process <br /> works and has many opportunities for citizens to voice their concerns. During the planning process <br /> many factors are negotiated, compromised or dramatically changed or people can choose the <br /> referendum process. If the Initiative passes projects could go directly to the voters without having <br /> to go through the planning process. She thought it was outrageous to have the applicants pay for <br /> the election. What will happen to the City's fiscal stability if the State redistributes sales tax <br /> revenue on a population basis? If CAPP passes how will the City pay for the pipeline extension? If <br /> CAPP passes what is the venue for addressing problems such as freeway congestion, regional air <br /> pollution,city street peak hour congestion and other issues? <br /> Ms. Acosta said sales tax distribution has been a legislative discussion for over ten years <br /> and with or without CAPP it would have a major impact on the City budget. <br /> Ms. Michelotti said if the point of sale in sales tax is redistributed it will impact the <br /> financing to the City. <br /> Mayor Tarver said he is looking for answers to the questions raised in regards to CAPP. <br /> Ms. Acosta said the replacement portion of the pipeline has always been envisioned to be <br /> paid for by the ratepayers,with the expansion portion coming from the connection fees. <br /> Mayor Tarver understood if CAPP passes and there is not a sewer pipeline expansion then, <br /> the replacement costs would be higher and paid for by the existing ratepayers. <br /> Ms. Acosta said no decision has been made on those issues. <br /> Peter MacDonald, 5253 Crestline Way, felt people were not looking at the big picture. This <br /> Initiative affects far more than Pleasanton. If CAPP is legal then other communities will be forced <br /> into CAPP type initiatives. CAPP represents a policy of no growth rather than planned growth for <br /> the entire region and the entire state. If CAPP passes children will not have a place to live and <br /> families will be forced to move out of California. <br /> Deborah Kleffman, 3027 Bliggs Court, wanted to indicate that Reduce Overcrowded <br /> Campuses Alliance(ROCA)was taking no stand on CAPP. She wanted to respond to a letter from <br /> the School District regarding the cooperative fee agreement and the repercussions if CAPP were <br /> passed. The letter states that the City did not do an adequate job on estimating the effects of CAPP <br /> on school facilities funding and that PUSD has a concern that it might be sued by the cooperative <br /> fee developers if the development obligations under that agreement were to be enforced. The letter <br /> outlines legal areas where the cooperative fee signatories may attempt to escape from their <br /> obligations in a post CAPP environment. Her concern is if the community is led to believe that <br /> cooperative fee developers are attempting to escape their obligations before paying for facilities and <br /> to avoid covering a shortfall,that this will only increase voters for CAPP and will work against the <br /> Pleasanton City Council I2 08/23/99 <br /> Minutes <br />
