Conditions of Approval of PUD-85-7 <br /> <br /> 1. That the development be substantially as shown on the <br /> development plan, Exhibit A, on file with the Planning <br /> Department. <br /> <br /> 2. That the developer follow all recommendations contained in <br /> the tree report for saving the trees identified as to be <br /> saved on the site plan. Such measures shall include but not <br /> necessarily be limited to providing barricades around the <br /> trees to protect their trunks, roots and low hanging <br /> branches. These barricades shall be set far enough from the <br /> trees to protect them from soil compaction and excavation. <br /> <br />3. That the developer shall follow all recommendations of the <br /> acoustical analyses prepared for this project. Interior noise <br /> levels shall be no greater than 45 dB Ldn. These <br /> construction techniques shall be included as part of the <br /> building plan submittal. <br /> <br /> 4. That no building permit for the project shall be issued until <br /> such time as a contract for the extension of Valley Avenue to <br /> Stanley Boulevard is let and the alignment of the Del Valle <br /> Parkway between Main Street and First Street is approved. In <br /> the event a contract cannot be let by May 6~ 1986, developer <br /> may propose interim engineering measures to mitigate the <br /> short-term impact of the project on existing Stanley <br /> Boulevard. Council approval of such engineering measure <br /> shall be deemed to be compliance with this condition. <br /> <br />5. That all building pads of the new development shall <br /> essentially match the existing at grade elevations along the <br /> west, north and east property lines. <br /> <br />6. That the uses and site development standards for the site <br /> adhere to those standards set for RM-4000 zoning districts, <br /> except that the developer may propose for the Planning <br /> Director's approval allowable patio area improvement <br /> requirements, such as decks, ~spas, patio covers, etc. <br /> <br />7. That the developer file and process a tentative tract map for <br /> this development. The PUD site development plan will be <br /> subject to possible change, at that time, with respect to <br /> utility systems and topography. <br /> <br />8. That the streets within this development be private drives <br /> and be maintained by a homeowners' association. <br /> <br />9. That the sanitary sewer system and the water system for this <br /> development be public and be within the private drives and <br /> within a public service easement. <br /> <br /> EXHIBIT B <br /> - 1 - <br /> <br /> <br />
