CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 03-063 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />RESOLUTION CONFIRMING THE IMPOSITION OF A <br />LIEN ON 4085 PEREGRINE WAY, PLEASANTON (APN <br />946-1252-112-00) FOR ADMINISTRATIVE COSTS <br />INCURRED WITH A NUISANCE ABATEMENT ACTION <br /> <br />responding to citizen complaints from March 1, 2001 through September 10, 2002, <br />the City issued at least eight warnings and two limited compliance orders to the <br />property owner of 4085 Peregrine Way to address the nuisance conditions on the <br />property; and <br /> <br />on November 12, 2002, the City issued Compliance Order 2002-17 declaring that <br />the front yard of 4085 Peregrine Way was a nuisance in violation of Pleasanton <br />Municipal Code Section 9.28.020 and requiring the property owner to remove all <br />materials and debris, including the jet ski trailer, from the front yard; and <br /> <br />when the property owner failed to abate the nuisance by November 22, 2002, an <br />Administrative Hearing was scheduled for December 19, 2002; and <br /> <br />after heating testimony from both the City and the property owner, the Hearing <br />Officer found the property to be a nuisance in violation of Chapter 9.28 of the <br />Pleasanton Municipal Code and ordered the removal of all "junk, trash, salvage <br />materials, boxes, lumber, various debris and trash, personal property, and vehicles, <br />i.e. the jet ski/personal water craft, and miler, except for the bricks" from the front <br />yard by December 22, 2002, with the property owner given additional time to <br />complete the brick wall in the front yard; and <br /> <br />the Heating Officer imposed administrative penalties escalating from $25 per day, <br />which were suspended when the violations were corrected by the given date; and <br /> <br />the Hearing Officer also imposed administrative costs in the amount of $281.01 <br />reflecting the cost of stafftime at the Administrative Hearing; and <br /> <br /> <br />
