CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 03-062 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />RESOLUTION ORDERING THE <br />LEMOINE RANCH ESTATES <br />ABATEMENT DISTRICT <br /> <br />FORMATION <br />GEOLOGIC <br /> <br />OF THE <br />HAZARD <br /> <br />on October 18, 1994, pursuant to Section 26550 of the Public Resources Code, this <br />Council adopted Resolution No. 94-118A, declaring the Council subject to the <br />provisions of Division 17 (Section 26500 et seq.) of said Code, and forwarded a <br />copy of said Resolution to the State Controller; and <br /> <br />on April 15, 2003, this Council adopted Resolution No. 03-027, initiating <br />proceedings for the formation of a geologic hazard abatement district ("GHAD") <br />for the Lemoine Ranch Estates, Tract 7176, setting a public heating on the filed <br />petition for May 20, 2003, and directing that notice of the hearing be mailed in <br />accordance with the requirements of Public Resources Code Section 26561 to all <br />the owners of ail the real property within the boundaries of the territory to be <br />included within the proposed GHAD; and <br /> <br />said notice of heating was mailed to all said owners of real property in accordance <br />with Public Resources Code Section 26561, or, in lieu thereof, all said owners of <br />real property submitted to the City Clerk written waivers of said notice of hearing; <br />and <br /> <br />at the time set for hearing, no owners of real property within the boundaries of the <br />proposed GHAD had made a written objection to its formation; and <br /> <br />it appeared at the hearing that the owners of more than 50 percent of the assessed <br />valuation of the proposed GHAD did not object to the formation thereof, and the <br />Council thereupon closed the heating; and <br /> <br />the formation of the proposed GHAD is not subject to the California <br />Environmental Quality Act or the Cortese-Knox Local Government <br />Reorganization Act of 1985, in accordance with Public Resources Code Section <br />26559 and Section 26560; and <br /> <br /> <br />
