ENGEO

INCORPORATED

Property located completely outside the GHAD boundary unless a geologic hazard affects
property within the Covered Area.

7. Earthquake-induced hazards including surface rupture within a lot or lots.

Within the Covered Area, the GHAD's responsibilities include general maintenance of the
surface drainage improvements such as the concrete V-ditches; general maintenance of the storm
drain outlets, including removal of brush and debris; detection and mitigation of potential
geologic hazards of the type addressed by the GHAD; and maintenance of emergency vehicle
access roads. Landscape maintenance work done by the GHAD shall be only as required for
erosion protection within the Covered Area.

C. Annexations to the GHAD

Annexation of properties not currently within the GHAD boundaries must be approved by the
GHAD Board of Directors. Prior to annexation approval, the property owner must establish that
the future revenue stream to the GHAD will be adequate to support the GHAD activities within
the area proposed to be annexed. Additionally, as a condition of annexation, the property owner
seeking annexation must contribute to the GHAD reserve fund in an amount to be determined by
the general manager, but which shall be based upon the size of the area to be annexed relative to
the area of the existing GHAD, and other relevant factors.

D. Geologic Hazards Addressed by the GHAD

The GHAD will address only the following geologic hazards:

· Surface rupture impacting geotechnical mitigation measures
· Slope instability
· Landslides
· Erosion
· Sedimentation

These terms are defined in Scope Section D, below.

4992.5.001.01
February 28, 2003 5 DRAFT 2
