BACKGROUND <br /> Assembly Bill AB 2286 (statutes 2008) went into effect January 1, 2009. It requires all <br /> Certified Unified Program Agencies ( CUPAs) and businesses regulated under the <br /> Unified Program to report electronically to the state by January 1, 2013. The new law <br /> specifies that all information gathered by the CUPA and required to be reported by the <br /> businesses is subject to this requirement. Unified Program information includes: <br /> • Facility data regarding hazardous material regulatory activities, <br /> • Chemical inventories, <br /> • Underground and aboveground storage tank data, <br /> • Hazardous waste generator data, and <br /> • Agency (CUPA) data such as inspections and enforcement actions <br /> All regulated businesses and CUPAs in the State of California must transition to an <br /> electronic based reporting system capable of exchanging data with the state system by <br /> January 1, 2013. AB 2286 requires that, in addition to any other funding that becomes <br /> available, the Secretary of the California Environmental Protection Agency increase the <br /> Unified Program oversight surcharge by an amount necessary to establish the data <br /> system. The Secretary increased the oversight surcharge by $25 each year for 3 years, <br /> with 75% of that funding to be provided to CUPAs through grant funds. <br /> Grant funds may be used to purchase or develop software, purchase hardware, training <br /> of both the business community and agency staff and funding other activities and <br /> purchases necessary to comply with the electronic reporting mandate. <br /> DISCUSSION <br /> The LPFD has already begun the process of complying with the AB 2286 mandate. For <br /> example, all Fire Prevention Bureau inspectors have been provided with Tablet PCs <br /> which can communicate rernotely with the Fire Department's database and the internet <br /> to facilitate collection of data electronically and efficiently.
