BACKGROUND <br /> The Sidewalk and Access Ramp Installation project is an annual City program. The <br /> City's Americans with Disabilities Act (ADA) Compliance Committee identifies and <br /> recommends locations for improvements that do not meet current ADA standards for <br /> existing crosswalk areas. The City of Pleasanton's Engineering Division considers the <br /> recommendations and reviews the areas for safety improvement urgency, proximity to <br /> other locations requiring work, scheduling of other street projects, and available budget <br /> when selecting locations to be improved each year. <br /> The project consisted of: construction of eight raised islands with passageways along <br /> Hopyard Road and 13 intersection ramps; installation of yellow detectable warning <br /> surfaces onto existing ramps at various locations; and replacement of damaged <br /> sidewalk, curb and gutter at various locations. There were a few locations where <br /> pedestrian push buttons needed to be adjusted for wheel chair access. The City of <br /> Pleasanton used Econolite (City's on call contractor for traffic signal maintenance) to <br /> perform this work. <br /> On July 20, 2010, the City Council ratified the award of the construction contract for the <br /> subject project to the lowest responsible bidder, Rosas Brothers Construction, in the <br /> amount of $133,172.50. Work included within the scope of this contract was required to <br /> be completed prior to the start of the City's Annual Resurfacing project. To meet the <br /> limited construction window and complete paving prior to the winter months, it was <br /> necessary for the City Manager to award the project in June and City Council ratified the <br /> award of contract in July. Council approved a total project budget of $282,039 which <br /> included $37,000 for the traffic signal push button adjustment and a contingency <br /> amount of $26,700. The subject project has since been completed and is ready for <br /> acceptance. <br /> DISCUSSION <br /> Budget <br /> The contract with Rosas Brothers Construction was within the approved budget and <br /> contingency. Change orders for Rosas Brothers Construction totaled $14,844, primarily <br /> due to additional concrete work for ADA accessibility requested by the City's ADA <br /> Committee. The Rosas Brothers contract, including change orders, totaled $148,017. <br /> Although the original estimate for the pedestrian push button adjustments performed by <br /> Econolite was $37,000, an additional $6,475 was required because an additional <br /> location was added that needed adjustment for accessibility purposes. The total cost of <br /> the Econolite work was $43,475. <br /> After award of the construction contract for this project, staff received notification that <br /> the litigation resolution for the previous year's Annual Sidewalk/Intersection Ramp <br /> Installation project (CIP No. 085005) with A -1 Septic disallowed the liquidated damages <br /> the City had calculated for that project's final payment. For this reason, the City paid <br /> the final amount of $8,677 to the State of California for distribution to settlement parties <br /> for CIP No. 085005.
