Mr. Tolleson stated that the proposal is considered to be an equivalent compliance <br />request which provides for the intent of the Code. He pointed out that two driveways <br />are currently located on the south entry side and west side yard. He noted that staff has <br />indicated that the purpose of the 20-foot side yard setback is to accommodate off-street <br />parking outside the garage. He stated that off-street parking would be provided, taking <br />the place of the west garage driveway at the existing south driveway, with no parking in <br />the west driveway. He noted that the property presents a unique set of conditions that <br />make equivalence to compliance possible. <br /> <br />With respect to the Conditions of Approval, Mr. Tolleson stated that 4267 Churchill Drive <br />is co-ecial <br />circumstances revolve around the atypical site and floor plan of the sales office model <br />limitations, he noted that no other similar variances exist in the community because no <br />other properties in the tract are similar to this property. He added that it was fire resistant. <br /> <br />Commissioner Blank commented that the space would then be habitable.
