Commissioner Pearce asked Mr. Murphy if it was his intent to operate Monday through <br />Friday. <br />Mr. Murphy replied that he lives in San Francisco and often works from his home or car <br />when conducting estimates and going to job sites. He added that it often involves <br />getting to the location, loading up the van, leaving in the morning and returning back <br />without any set hours. He noted that the hours are typically those that have minimal <br />impact on the neighbors. <br />THE PUBLIC HEARING WAS CLOSED. <br />Ms. Decker clarified that Condition No. 10 is intended for applicants who have not <br />moved into their sites such that if they have been granted a use permit and are getting <br />building permits for tenant improvements, they have one year to obtain their business <br />license. She noted that since Mr. Murphy has been at the location for 18 months and it <br />is uncertain whether or not he has a business license on the premises, staff is <br />recommending modifying the condition to require him to obtain his business license <br />within 30 days of the use permit approval since. She then briefly described the process <br />for securing a business license. <br />Ms. Harryman proposed the new language for Condition No. 12 as follows: “If the <br />applicant wishes to relocate the use to a new address or tenant suite, the applicant shall <br />obtain approval from the Planning Commission to transfer the Conditional Use Permit to <br />the new location prior to occupying the new location. Upon approval of the transfer, the <br />Conditional Use Permit issued to the prior location shall terminate.” <br />Commissioner Blank moved to make the Conditional Use Permit findings listed in <br />the staff report and to approve Case PCUP-260, subject to the Conditions of <br />Approval listed in Exhibit B of the staff report, with the following modifications: <br />(1) Revise the language for Condition No. 12 as proposed by Ms. Harryman; <br />(2) Modify Condition No. 10 to require the applicant to get a business license <br />within 30 days rather than one year; and (3) Modify Condition No. 5 to limit <br />deliveries to Monday through Friday. <br />Commissioner Narum seconded the motion. <br />ROLL CALL VOTE: <br />AYES: Commissioners Blank, Narum, O’Connor, Olson, and Pearce. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: Commissioner Pentin. <br />Resolution No. PC-2010-01 approving PCUP-260 was entered and adopted as <br />motioned. <br />PLANNING COMMISSION MINUTES, January 27, 2010 Page 9 of 15 <br /> <br />
