Please confirm that upon submitting Construction Drawing to the building <br />department the current green requirement will be “Grandfathered in” if submittal <br />st <br />is made on or before December 31, 2010. <br />The applicability of LEED or CALGreen is based on when the building permit is <br />received by the Chief Building Official not when the building permit plan set is <br />issued. CALGreen, the California State Green Building Standards, takes effect <br />on January 1, 2011. <br />4. Driveway materials shall be concrete but do not have to be stamped or colored. <br />Guideline 3. (Final Design Guidelines, Page 2 of 13 of PUD-01-01M) specifies <br />stamped colored concrete. Covered by Condition #12 of PDR-033. I previously <br />discussed this requirement with you and it was verbally accepted. <br />5. Please show evidence for the requirement that 50% of the trees be 24” box. <br />(Item 11, Comment letter, October 19, 2010) <br />Guideline 2.3 (Final Design Guidelines, Page 11 of 13 of PUD-01-01M). <br />Covered by Condition #10 of PDR-933. <br />6. Please show evidence that backyard landscape plans are required at building <br />permit. <br />(Condition 9 of PDR-933). Normally, a landscape plan for the entire site is <br />provided with development applications including custom lots. In order to <br />expedite your application to the Planning commission, we deferred the complete <br />landscape plan to the building permit. Landscape and irrigation plans are <br />reviewed as part of the building permit package for conformance to Municipal <br />Codes, Building Codes, and California State Law. (FYI – the applicant’s <br />landscape architect is required to verify compliance). Reviewing the complete <br />package also ensures that the individual drawings are consistent with each other. <br />7. Please show evidence that an open style fence is required at the back property <br />line and that plans for fencing are required. <br />(Item 13, Comment letter, October 19, 2010) <br />Fencing is covered by Guideline 4.b. (Final Design Guidelines, Page 12 of 13 of <br />PUD-01-01M) specifies solid fencing on the side property lines of these lots, but <br />is open to the type of fencing on the rear property. The East Bay Regional Park <br />District has specified open fencing by its facilities. I suggested a wrought-iron <br />style fence to you in my comment letter. The Renquist lot placed a wire deer <br />fence along its rear property line. Condition #5 of PDR-033 requires the fencing <br />conform to the design guidelines and that a fencing plan be provided at the <br />PLANNING COMMISSION MEETING MINUTES, November 10, 2010 Page 8 of 13 <br /> <br />
