Mr. Pavan replied that was the case and added that EBRPD’s position is not to allow <br />water craft in the area. <br />Commissioner Pentin inquired if the slope was very steep from the back of the property. <br />Mr. Pavan said yes. <br />Mr. Pavan noted an error in the staff report, indicating that the 3,900-square-foot area <br />includes the floor area of the second floor attic space. <br />Commissioner O’Connor referred to windows overlooking the Park area and noted that <br />the window over the west side does not look into the Park. <br />Mr. Pavan stated that the PUD conditions of approval clearly state that all second-floor <br />windows are to be treated as dormers facing south. <br />Chair Olson inquired what would be entailed to change this condition. <br />Mr. Pavan replied that it would require a modification to the PUD. <br />Commissioner O’Connor inquired if a variance would be possible. <br />Mr. Pavan said no and reiterated that a PUD modification would be required. <br />Commissioner Narum inquired what the thinking was behind not allowing windows. <br />Ms. Stern explained that a PUD Modification would come back to the Commission and <br />that staff would review it with the EBRPD as well. <br />Commissioner O’Connor commented that it was interestingly that this condition was <br />placed only with the five homes and that homes to the southeast and west have a much <br />better view into the area but do not have restrictions on any windows. <br />Commissioner Blank stated that in the past, the Commission has asked for and was <br />provided with Minutes from the original meetings from where those conditions were <br />developed so the Commissioners would have a better understanding of the <br />interpretation and the reason behind it. He inquired if the Planning Commission and <br />Council meeting Minutes could be made available to the Commission. <br />Ms. Stern stated that staff does not have those documents at hand but would be able to <br />provide them. <br />Commissioner O’Connor inquired if the EBRPD would be noticed if a PUD modification <br />were requested. <br />Ms. Stern said yes. <br />PLANNING COMMISSION MEETING MINUTES, November 10, 2010 Page 6 of 13 <br /> <br />
