c. PDR-933, Tim Cotton <br />Application for Design Review approval to construct an approximately <br />3,972-square-foot, two-story custom home with an attached one-car <br />garage and an attached two-car garage at 2517 Yolanda Court. Zoning <br />for the property is PUD-LDR (Planned Unit Development – Low Density <br />Residential) District. <br />Marion Pavan presented the staff report and described the scope, layout and key <br />elements of the project. <br />Commissioner O’Connor requested clarification on the two concerns of the East Bay <br />Regional Park District (EBRPD). <br />Mr. Pavan replied that EBRPD is concerned that the massing of the home at the <br />property would cause a negative impact on the privacy and tranquility of the Park’s pond <br />area. <br />Commissioner Pentin clarified that the proposed setback of the home is 40 feet. <br />Mr. Pavan confirmed that the proposed house is set back 40 feet although the required <br />setback is only 30 feet. He added that EBRPD would like to see open fencing as <br />opposed to solid board fencing back up to the property. <br />Commissioner Pentin commented that it seemed strange that EBRPD wants to protect <br />the privacy of the pond users but wants open fencing so the house can be seen. <br />Commissioner Blank stated that he thinks the reason for this is because there may not <br />be a 40-foot setback if solid fencing was installed on the property line, and the house <br />would look less massive with an open grill fence. <br />Commissioner O’Connor stated that the same massing would be seen regardless of <br />whether or not there is a window in a building. <br />Mr. Pavan added that the District was concerned with what will be seen from the park <br />and that it wanted a one-story building wall and a roof sloping back and away from the <br />Park District property line, reducing the visual massing and impact of the homes on <br />these lots to the Park property. <br />Commissioner O’Connor inquired how the pond is accessed. <br />Referring to the area plan, Mr. Pavan pointed out and described the trails leading to the <br />pond area. <br />Commissioner O’Connor inquired if there is no water craft access to the pond. <br />PLANNING COMMISSION MEETING MINUTES, November 10, 2010 Page 5 of 13 <br /> <br />
