payment. The second outstanding item relates to the Housing Element and presentation to <br /> HCD. Staff is currently working on the Housing Element and is on schedule. The third item is <br /> adoption of the Climate Action Plan, set for February 17, 2012 which is progressing and on <br /> schedule. <br /> Although not part of the settlement agreement, he said the Council directed staff to work on a <br /> review of the Growth Management Ordinance. Staff met with the Council subcommittee on the <br /> matter and is planning to hold another meeting late March /early April with a goal to mirror and <br /> track the timeline for the Housing Element. <br /> Councilmember Sullivan suggested scheduling an update at a Council meeting for the Housing <br /> Element and combining it with an update on the Growth Management Ordinance discussions. <br /> Councilmember Sullivan referred to the draft inventory and confirmed with Mr. Fialho that it has <br /> been transmitted to Urban Habitat and to nonprofit housing developers, per the settlement <br /> agreement, a copy of which he agreed to provide to the Council. <br /> Councilmember McGovern voiced concern in being able to maintain local City control over its <br /> process for developing housing units within the Housing Element. Mr. Fialho acknowledged that <br /> this matter has to do with discretionary authority by the Council to proceed with the PUD <br /> process employed on projects with anything zoned 30 units to the acre. He said staff is still <br /> discussing the City's opinion on this with HCD. They have also requested the City Attorney's <br /> Office to provide a legal opinion so that staff can prepare the Council for the discussion as part <br /> of the Housing Element approval process. <br /> Councilmember Sullivan suggested holding the discussion at the same meeting with the <br /> Housing Element and Growth Management Ordinance items. <br /> Councilmember McGovern asked when the decision will be made on Hacienda Business Park <br /> as to whether housing units will be included in RHNA numbers. Mr. Fialho said the question as <br /> to at what point the City looks at development entitlement within the business park and change <br /> assumptions warrants a broad discussion by the Council and the business park prior to the <br /> Housing Element adoption, as it has implications across that geographic area of town. <br /> MATTERS INITIATED BY COUNCIL <br /> Councilmember McGovern referred to Indian remains being found when Safeway was being <br /> built, and she questioned what will happen on the site. Mr. Fialho said a specific protocol in <br /> terms of the remains' relocation process was adopted as part of the EIR which must be followed <br /> by the developer. He said it is part of the monitoring and mitigation plan adopted in the Phase II <br /> Specific Plan. He noted that the situation also occurred when grading was done with the Bernal <br /> Community Park as well as construction of the KB Homes. <br /> Councilmember Sullivan requested staff send the Council a status update on what has been <br /> found. <br /> Councilmember Thorne referred to the streamlining of water agencies. He said LAVMA will <br /> present its budget in April and it will significantly reduce administrative costs and cutting back on <br /> the General Manager's hours.
