THE TRI-VALLEY WATER RETAILERS COOPERATION AGREEMENT <br /> <br />O~.gSo <br /> <br />This Agreement is entered into and becomes effective on this 7-q day of <br /> <br /> ,2002, by and between the Dublin San Ramon Services District and the City of <br /> <br />Livermore. <br /> <br /> RECITALS <br /> <br /> A. The Dublin San Ramon Services District ("DSRSD") has been designated by the <br />Local Agency Formation Commission ("LAFCO") as the provider of retail water delivery <br />services in portions of its service area, including its entire service area in Alameda County and <br />its Dougherty Valley service area in Contra Costa County; <br /> <br /> B. The City ofLivermore ("Livermore") has been designated by LAFCO as the <br />provider of retail ~v~ter delivery services in portions of its incorporated territory; <br /> <br /> DSRSD and Livermore desire to cooperate in achieving a safe and reliable water <br /> <br />supply; <br /> <br /> D. <br /> <br /> The City ofPleasanton ("Pleasanton") has been designated by LAFCO as the <br />provider of retail water delivery services in all of its incorporated territory; <br /> <br /> E. California Water Service Company ("CWS") has been granted a franchise by the <br /> <br />California Public Utility Comlmission to provide retail water delivery service in portions of the <br />incorporated territory of the City of Livermore; <br /> <br /> F. Livermore, DSRSD, and CWS have entered into substantially similar agreements <br /> <br />with Zone 7 of the Alameda County Flood Control and Water Conservation District ("Zone 7") <br />for a municipal and industrial water supply. Pleasanton purchases a substantial portion of its <br />surface water supply for municipal and industrial use from Zone 7. Therefore, Livermore, <br /> <br /> <br />
