RESOLUTION NO. 10- <br />ATTACHMENT 1 <br />RESOLUTION DENYING CASE PAP -152, THEREBY UPHOLDING THE PLANNING <br />COMMISSION'S APPROVAL OF THE APPLICATION OF FREDRIC AND YIPING <br />LEROUDIER FOR AN ADMINISTRATIVE DESIGN REVIEW APPLICATION, AS <br />FILED UNDER CASE PADR -2138 <br />WHEREAS, Fredric and Yiping Leroudier applied for an Administrative Design <br />Review application to install a second -story window on the right (south side) elevation of <br />the existing residence located at 5252 Meadowwood Court; and <br />WHEREAS, zoning for the property is R -1 -6,500 (One - Family Residential) <br />District; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Kong <br />Susanto and Catharine Pranoto submitted an appeal of the Zoning Administrator <br />approval to the Planning Commission; and <br />WHEREAS, at its meeting of February 9, 2011, the Planning Commission, <br />having considered all public testimony, relevant exhibits, and recommendations of City <br />staff concerning this application, denied the appeal but amended the conditions of the <br />Zoning Administrator's approval; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Fredric <br />and Yiping Leroudier submitted an appeal of the decision of the Planning Commission <br />to the City Council; and <br />WHEREAS, at its meeting of March 15, 2011 the City Council received a report <br />from the Director of Community Development, together with a copy of the staff report to <br />the Planning Commission, regarding this matter; and <br />WHEREAS, the City Council held a public hearing on March 15, 2011, at which <br />time the appellants and any other member of the public were offered an opportunity to <br />present evidence regarding the appeal; and <br />WHEREAS, after a review of the materials presented, the City Council <br />determined that, as conditioned, the proposed window would be appropriate for the site <br />and would be consistent with the zoning regulations of the zoning district of the <br />property. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE <br />FOLLOWING: <br />Section 1.
