Mr. Susanto and Ms. Pranoto were not satisfied with the action taken by the Zoning <br />Administrator and filed an appeal of that decision to the Planning Commission (Please <br />refer to Attachment 6, Exhibit H for the Planning Commission appeal letter). <br />Planning Commission Hearing <br />During the February 9, 2011, Planning Commission meeting, and as stated in the <br />neighbors appeal letter (Attachment 6, Exhibit H), they requested that the Commission <br />consider one of the following two options: <br />Option 1: Require the Leroudiers to install a larger window on the east elevation that <br />would meet the egress requirements, to which Mr. Susanto and Ms. <br />Pranoto would contribute up to $200.00 to the cost of installing a larger <br />window, in order for the Leroudiers to install a window on the south <br />elevation that had a minimum sill height of 6 -feet. <br />OR <br />Option 2: Require the Leroudiers to install a minimum of four Italian Cypress trees, <br />planted as closely as possible and maintained to grow at least 20 -feet in <br />height, to provide privacy screening along the south elevation. <br />Prior to the publication of the Planning Commission staff report, staff requested that the <br />City's Landscape Architect, Mike Fulford, provide his professional opinion on whether <br />Option 2 would be appropriate. Mr. Fulford suggested that the Leroudiers plant three <br />Leyland False Cypress trees for privacy screening. Leyland False Cypress is an <br />upright, dense, evergreen tree that grows 10 -12 -feet wide and 15 -20 -feet in height <br />within 5 years; unlike Italian Cypress, which is slow growing. Staff, therefore, added a <br />new recommended condition of approval for the Planning Commission's consideration <br />that required the Leroudiers to install three Leyland False Cypress trees. <br />During the meeting, the Commission discussed whether there were alternative <br />landscaping options that could be pursued by staff verses what was initially suggested <br />by Mr. Fulford. The Leroudiers stated that they opposed installing landscaping and felt <br />that it shouldn't be required since the neighbors also have second -story windows that <br />look onto their adjacent neighbors' properties. <br />After considering all public testimony, the Planning Commission denied the appeal, <br />thereby upholding the Zoning Administrator's approval, but modified staffs <br />recommended condition of approval requiring the Leroudiers to install landscaping with <br />the size, location, number, and species selected by the Director of Community <br />Development. <br />The Planning Commission meeting minutes can be found in Attachment 5 and the staff <br />report can be found in Attachment 6 for the Council's consideration. <br />Page 4 of 8 <br />
