Ordinance No. <br /> Page 3 <br /> (2) Amend Section 9.14.040 as follows: <br /> 9.14.040 Discharge of pollutants. <br /> The discharge of ronstormwater discharges to the city storm sewer system is prohibited. <br /> All discharges of rnaterial other than stormwater must be in compliance with a NPDES <br /> permit issued for the-discharge to the discharger (other than the City's current NPDES <br /> Permit No. CA0020831). <br /> (3) Amend Section 9.14.050, subsection B., as follows: <br /> 9.14.050 Exceptions to discharge prohibition. <br /> B. Discharges from the following activities will not be considered a source of pollutants <br /> to waters of the Llnited States when properly managed: water line flushing and other <br /> discharges from potable water sources, landscape irrigation and lawn watering, irrigation <br /> water, diverted stream flows, rising ground waters, infiltration to separate storm drains, <br /> uncontaminated pumped ground water, foundation and footing drains, water from crawl <br /> space pumps, air conditioning condensation, springs, individual residential car washings, <br /> flows from riparian habitats and wetlands, _ - - - -- - - -- e - - e or <br /> flows from firefighting and accordingly_are not subject to the prohibition on discharges. <br /> Discharges from swimming pools, spas, and ponds should be directed to the sanitary <br /> sewer or landscaping that can accommodate the volume. <br /> {the remaining provisions of Section 9.14.050 are unchanged) <br /> (4) Amend Section 9.14.060 as follows: <br /> 9.14.060 Discharge in violation of permit. <br /> Any discharge that would result in or contribute to a violation of the City's current <br /> NPDES Permit Ne- CA9929834, and any amendment, revision or reissuance thereof, <br /> either separately considered or when combined with other discharges, is prohibited. <br /> Liability for any such discharge shall be the responsibility of the person(s) causing or <br /> responsible for the discharge, and such persons shall defend, indemnify and hold <br /> harmless the city n any administrative or judicial enforcement action relating to such <br /> discharge. <br /> (5) Amend Section 9.14.080, subsection C., as follows: <br /> 9.14.080 Reduction of pollutants in stormwater. <br /> C. Best Management Practices (BMP) for New Developments and Redevelopments. <br /> Any construction contractor performing work in the city shall endeavor, whenever <br /> possible, to follow the most current California Stormwater Quality Association (CASQA) <br /> construction BMP manual in order to prevent any debris and dirt flowing into the city's <br /> storm sewer system. The operations services director or his or her designees may <br /> establish controls on the volume and rate of stormwater runoff from new developments <br /> and redevelopments as may be appropriate to minimize the discharge and transport of <br /> pollutants. <br /> (the remaining provisions of Section 9.14.080 are unchanged) <br />
