Any action brought against the city upon any claim or demand shall conform to the <br /> requirements of Sections 940 -949 of the California Government Code. Any action brought <br /> against any employee of the city shall conform with the requirements of Section 950 -951 of the <br /> California Government Code. <br /> 1.04.100 Payment of taxes prior to refund or judicial relief. <br /> No legal or equitable process shall be issued in any proceeding in any court against the city or <br /> any officer of the city to prevent or enjoin the collection of any tax. After payment of a tax <br /> claimed to be illegal, not due and /or owing, and /or incorrectly calculated, an action may be <br /> maintained to recover the tax paid; provided, that prior to any judicial action all administrative <br /> remedies shall be exhausted. <br /> B. Amend Chapter 2.24 Fire Department as follows: <br /> 2.24.010 Organization. <br /> The fire department of the city shall be formed, organized, operated and conducted <br /> under and in accordance with the provicions of this chapter joint agreement with the City <br /> of Livermore. It shall be known as "the Livermore - Pleasanton Ffire Ddepartment of thc <br /> city of PI asanton," hereafter called "the fire department." <br /> 2.24.020 Firefighters — Generally. <br /> The fire department shall be operated and staffed as agreed upon with the City of <br /> Livermore compes _ e - - •• - - - - ' • - - - - •- - <br /> provided- for-- by -4he fire department. The number of active firefighters belonging to said <br /> fire- department -may, within thc limits established by this chapter, be fixed by resolution <br /> adopted from time to time by the city council. <br /> C. Amend Chapter 9.08 Litter as follows: <br /> 9.08.120 Placing handbills on vehicles. <br /> No person shall throw or deposit any commercial or noncommercial handbill in or <br /> upon any vehicle if such handbills create significant litter. <br /> D. Amend Chapter 9.14 Stormwater Management and Discharge Control as follows: <br /> (1) Amend Section 9.14.030 as follows: <br /> 9.14.030 Responsibility for administration. <br /> This chapter shall be administered for the city by the operations services director or his <br /> or her designee. Where storm drain facilities and /or watercourses have been accepted <br /> for maintenance by the Alameda County flood control and water conservation district <br /> (ACFCWCD) or other public agency legally responsible for certain watercourses, then <br /> the responsibility for enforcing the provisions of this chapter may be assigned to such <br /> agency (through contract or agreement executed by the city and such agency) with <br /> respect to those watercourses for which they have accepted maintenance. This chapter <br /> shall be construecl to assure consistency with the requirements of the Federal Clean <br /> Water Act and acts amendatory thereof or supplementary thereto, applicable <br /> implementing regulations, and the City's current NPDES Permit No. CA0020831 and any <br /> amendment, revision or reissuance thereof. <br />
