Mitigated/
Resolved
Applicant Compromise / Resolution / Rebuttal
The proposed second floor has been designed so that it is close
to the front of the home (further away from the rear neighbors).
The only bedroom window that will face the Persin's backyard is
more than 40 ft distance from the property line and more than 60
ft distance from the backyard patio and pool. Wth these
distances the line of site is limited into their backyard. Mitigation
To lessen the impact of reduced privacy the applicant have
agreed to reduce the size of the bedroom window, reduce the
size of the two bathroom windows, raise both bathroom windows
above view, and to plant landscaping to maintain each parties
privacy. In addition the applicant's will continue to respect both
audio and visual privacy, as they have for twelve years. The
annlicant's are very aware of Pleasanton's Community of
Resolution: David and Stephanie's home as well as Hans and
Roxana's home is to the south of the proposed addition. There is
no sunlight that is blocked any time of the year.
This term "view" has been loosely used throughout the process.
To be clear. there is no "view" of mountains, hills, or oceans. Th:
view that is currently seen is of neighborhood tree tops, homes,
and sky. Resolution: To resolve this issue the proposed roof
has been designed with minimal slope to reduce the overall
height and appearance of bulk and mass, and the roof is side
gabled making the massing reduced toward the rear.
Whenever a neighborhood sees a homeowner that re- invests/
upgrades their home, and does so with a well designed home, a:
with this proposed addition, then the surrounding neighborhood
property values increase, not decrease. Resolution: The
resolution is to build this well designed proposed addition to '
assist in increasing the neighborhood's property value.
Resolution: There are currently 15 two story homes in the Val
Vista community, with the last one finishing construction in June
2010. No restrictions against a two story home exists for the
subject property or surrounding properties. In fact the
Declaration of Restrictions (CC &R's) for tract 2953 (Homer and
Robin Ct.), written in 1969, affirms that this neighborhood was
developed to support one and two story homes. The CC &R's
were given to all homeowners when they purchased their home
to make them aware that they, or their neighbors, have the abiliti
to build up to 2 1/2 stories.
Raised By:
c
N
U)
a
m
c
as
L
O
v
cn
as
as
David and Stephanie Persin
Hans and Roxana Hoehne
David and Stephanie Persin
Hans and Roxana Hoehne
David and Stephanie Persin
Hans and Roxana Hoehne
Joe and Tina Marie Perry
David and Stephanie Persin
Hans and Roxana Hoehne
Appellant Issue / Argument
Proposed addition will reduce privacy
Proposed addition will block sunlight
Proposed addition will block "view'
Proposed addition will cause reduction in home value
Two story homes are not consistent with neighborhood
01
CO
V
)()
Summary of Appellanis Issues / Arguments
