The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />The applicants are able to provide the code-required parking -six parking <br />spaces -for their use. Because the proposed use is oriented exclusively <br />towards motorcycles, which when pazked occupy a significantly smaller <br />area than that occupied by afull-size caz or truck, there would be more <br />than sufficient parking available for employees and customers. The <br />proposed use is to be operated entirely indoors and the activities should <br />not interfere with adjacent uses. As conditioned, all occupancy and <br />related requirements of the Pleasanton Municipal Code, Fire Code, and <br />Uniform Building Code would be met by the proposed use. <br />The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br />The site's zoning conditionally permits motorcycle sales, repair, and related <br />uses and the incidental sale of motorcycle parts, apparel, and accessories. <br />The proposed use complies with all relevant sections of the zoning ordinance. <br />WHEREAS, the Planning Commission determined that the proposed conditional use <br />would be compatible with nearby businesses and appropriate for the site. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-65, the application of Pacific Custom Cycles, Inc. <br />(Greg Chess and Catherine Kupper) for a conditional use permit to allow <br />motorcycle maintenance, modification, and repair, and the sale of <br />motorcycles, appazel, parts, and accessories in an existing building located at <br />3862 Old Santa Rita Road, subject to the conditions shown in Exhibit "B," <br />attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
