Resolution No. PC-2002-62
Page 2
2. The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be
detrimental to the public health, safety, or welfare, or materially
injurious to the properties or improvements in the vicinity.
The applicants are able to provide the code-required parking -six parking
spaces -for their use. Because the proposed use is oriented exclusively
towards motorcycles, which when pazked occupy a significantly smaller
area than that occupied by afull-size caz or truck, there would be more
than sufficient parking available for employees and customers. The
proposed use is to be operated entirely indoors and the activities should
not interfere with adjacent uses. As conditioned, all occupancy and
related requirements of the Pleasanton Municipal Code, Fire Code, and
Uniform Building Code would be met by the proposed use.
The proposed conditional use will comply with each of the applicable
provisions of the Zoning Ordinance.
The site's zoning conditionally permits motorcycle sales, repair, and related
uses and the incidental sale of motorcycle parts, apparel, and accessories.
The proposed use complies with all relevant sections of the zoning ordinance.
WHEREAS, the Planning Commission determined that the proposed conditional use
would be compatible with nearby businesses and appropriate for the site.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
PLEASANTON RESOLVES THE FOLLOWING:
Section 1. Approves Case PCUP-65, the application of Pacific Custom Cycles, Inc.
(Greg Chess and Catherine Kupper) for a conditional use permit to allow
motorcycle maintenance, modification, and repair, and the sale of
motorcycles, appazel, parts, and accessories in an existing building located at
3862 Old Santa Rita Road, subject to the conditions shown in Exhibit "B,"
attached hereto and made part of this case by reference.
Section 2. This resolution shall become effective 15 days after its passage and adoption
unless appealed prior to that time.
