these lots at the time of the lot-specific, design review application. Said drains shall be <br />connected to the street gutter or other means acceptable to the City Engineer. <br />29. There shall be no direct roof leaders connected to the street gutter or storm drain system. <br />30. All existing drainage swales that are filled shall have subdrains installed unless otherwise <br />recommended by the project developer/subdivider's Soils Engineer and approved by the <br />City Engineer. All subdrains shall have a cleanout installed at the beginning of the pipe. <br />The bottom of the pipe shall terminate in a storm drain or other storm drain outfall; sub- <br />ject the approval of the City Engineer. The applicant's engineer shall submit a final sub- <br />drain location map to the City Engineer prior to acceptance of the Public Improvements. <br />It shall be the responsibility of the homeowner to relocate the subdrain, if during the ex- <br />cavation of a pool or other subsurface structure a subdrain is encountered. All owners <br />within the subdivision shall receive notice of the presence of these subdrains. The City <br />Attorney shall approve said notice before the first lot sale. <br />31. The project developer/subdivider shall acquire written permission from adjoining prop- <br />erty owner(s) for any work to be done on their properties. Proof of such permission shall <br />be provided to the City Engineer prior to the issuance of a grading permit. <br />32. The project developer shall dedicate to the City for street right-of--way purposes those <br />parcels of land intended to be public streets. <br />33. The project developer shall grant an easement to the City over those parcels needed for <br />public service easements (P.S.E.) and which are approved by the City Engineer or other <br />easements, which may be designated by the City Engineer. <br />34. The project developer shall install street trees per lot as shown on the Sheet 3 - Concep- <br />tual Landscape Planting Plan of Exhibit A. The trees shall be shown on the improvement <br />plans submitted in conjunction with the final subdivision map to the satisfaction of the <br />Planning Director and the City Engineer before City Council approval. The trees shall be <br />installed a8er completion of the public street improvements and shall be irrigated, main- <br />tained, and replaced, if necessary, by the project developer/subdivider and subsequently <br />by the development's Homeowner's Association. <br />35. The City shall undertake a feasibility study of all potential alternatives for a permanent <br />bypass road to the golf course prior to the completion of this project. The City shall take <br />an aggressive approach to completing the feasibility study which shall take no more than <br />six months to complete. No occupancy of the houses covered by this approval shall be <br />permitted nor shall the golf course be allowed to open for business until the City Council <br />makes a decision on the issue of the bypass road alternatives. Once the decision is made, <br />construction of the by-pass road shall be expedited. <br />Final Conditions of Approval Page 6 of 7 Planning Commission (August 28, 2002) <br />
