PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2002-53 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />BERNAL PARTNERS, LLC FOR A MODIFICATION TO THE BERNAL <br />PROPERTIES PUD DEVELOPMENT PLAN, AS FILED UNDER CASE <br />PUD-02-4M <br />WHEREAS, Bernal Partners, L.L.C. has applied for a modification to the Bernal <br />Properties PUD development plan to allow a 1,300-square-foot drive- <br />through carwash and alcoholic beverage sales from the convenience <br />market located at 1875 Valley Avenue (southeast corner of Bernal Avenue <br />and the Valley Avenue extension); and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C-O <br />(Commercial and Office) District; and <br />WHEREAS, at its duly noticed public hearing of August 14, 2002, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, the Planning Commission recommended approval of the negative <br />declaration prepared for this project; and <br />WHEREAS, the Planning Commission made the following PUD findings: <br />The proposed development plan is in the best interests of the <br />public health, safety, and general welfaze. <br />The proposed project as designed and conditioned meets all applicable <br />City standards concerning public health, safety, and welfaze, e.g., vehicle <br />access, geologic hazards (new development not within a special studies <br />zone), and flood hazards. Full public street infrastructure including curb, <br />gutter, and sidewalks; streets and bus stops; and water, storm, and sanitary <br />sewer lines are present to serve the proposed development on this site. All <br />on-site infrastructure shall be installed by the project developer. The <br />limited sales of beer and wine from the proposed convenience market is <br />appropriate. There aze commercial establishments including restaurants <br />nearby the project where alcohol is offered for sale and consumption. <br />California State law places restrictions on the concun•ent sale of fuel and <br />alcohol which are referenced in the conditions of approval and which <br />would be followed by the facility's owners and operators. <br />
