Exhibit "C" <br />PCUP-61, Draft Conditions of Approval per Planning Commission <br />Bernal Retail Complex/Service Station, 1875 Valley Avenue <br />August 14, 2002 <br />1. Approval of this conditional use permit shall be contingent upon approval of the PUD <br />development plan and development plan modification, Case PUD-02-4M. <br />2. The project developer shall continue to work with staff to reduce the carwash dryer noise <br />levels to lowest extent feasible and shall submit a detailed analysis of the carwash dryer <br />noise to the Planning Director for review prior to issuance of a building permit. The <br />scope of the report shall conform to the noise report requirements of the Pleasanton Gen- <br />eral Plan and shall assess the noise impacts from the carwash dryer and from the drive- <br />through order speakers to the south and east side properties of the service station. Based <br />on the results of the noise analysis, the Planning Director may require noise mitigation <br />measures including the limited installation of soundwalls along portions of the south and <br />east property lines of the project site. <br />3. The car wash shall be designed and constructed with the noise reduction package refer- <br />enced in the letter from Bernal Partners, L.L.C., to Marion Pavan, dated August 7, 2002. <br />This detail shall be shown on the building permit plan set to the satisfaction of the Plan- <br />ning Director before issuance of a building permit. The noise reduction package shall be <br />maintained throughout the life of the carwash. <br />4. The service station operator shall provide to staff annually an analysis of the carwash <br />noise levels demonstrating compliance with the City's noise ordinance (maximum 60 <br />dBA) at the eastern property line of the project site. <br />5. At no time shall balloons, banners, pennants, or other attention-getting devices be utilized <br />on the site except as allowed by Section 18.96.060K of the Zoning Ordinance for grand <br />openings or by Section 18.116.040 of the Zoning Ordinance if approved by temporary <br />conditional use permit as part of a decorating plan in conjunction with shopping center <br />promotional events. At no time shall spot lighting be used after 10:00 p.m. in conjunc- <br />tion with such grand openings and/or promotional events. <br />6. If operation of this use, including the drive-through lanes, results in conflicts pertaining <br />to parking, noise, traffic, the sale of alcohol from the convenience market, or other im- <br />pacts, at the discretion of the Planning Director, this conditional use permit may be re- <br />ferred to the Planning Commission for subsequent review at a public hearing. If neces- <br />sary, the Planning Commission may modify or add conditions of approval to mitigate <br />such impacts, or may revoke said conditional use permit. <br />PUD-02-4M&PCUP-61 Page IS oj17 Planning Commission Recommendation <br />
