e. Building Plans/Architecture -The building plans/architecture shall <br />incorporate the following: <br />(1) No model shall be used on fewer than three of the MDR lots. <br />However, no model shall be used on more than six of the MDR <br />lots. The final house plotting plan shall strive to avoid placing two <br />of the same models adjacent to each other, facing the same street. <br />In the event adjoining lots have the same model, they shall have <br />different elevations. Lots 10 and 14 shall use model "Plan 1." <br />(2) The final colors and materials shall be submitted for the review <br />and approval of the Planning Director prior to the issuance of a <br />building permit for any of the homes. <br />(3) The final building elevations, showing all window and trim <br />detailing, shall be reviewed and approved by the Planning Director <br />prior to issuance of a building permit. Revisions shall be made to <br />the azchitectural plans in Exhibit A to include fenestration and <br />roofing changes referenced in a letter, dated July 2, 2002, from <br />Greenbriaz Homes to Planning Department staff. <br />Cernnd iinitc <br />5. This PUD Development Plan approval shall function as a conditional use permit <br />for the second units which may be constructed at the time of initial construction, <br />as shown on the originally approved building permit plans. The following <br />requirements shall apply: <br />a. Only one (1) residential unit on the subject property may be rented. The <br />other unit shall be owner-occupied. The dwelling's owner shall be <br />signatory to any lease for the second unit. The second unit shall be <br />occupied by no more than two (2) adults, although there shall be no limit <br />on the number of children. The project developer shall prepaze a deed <br />restriction to this effect for these lots and shall submit it to the City <br />Attorney for review and approval prior to issuance of the first building <br />permit containing a second unit. <br />b. In no case shall the second unit be sold, .subdivided, or held under <br />different legal ownership from the primary residence. <br />c. One (1) off-street pazking space shall be made continuously available to <br />the occupant(s) of the second unit for pazking. In the event that the <br />occupant(s) of the second unit own and operate more than one (1) auto, all <br />vehicles shall be accommodated on-site. <br />d. The project developer shall install address signs that are visible from the <br />street, clearly indicating that two (2) sepazate units exist on the pazcel. <br />The project developer shall obtain the new street address for the second <br />unit from the Planning Department. <br />Conditions of Approval Page 7 of 28 8/2/02 <br />Greenbriar Homes (PUD-14) <br />
